WHAT IS COVERED

HTRP warrants the products it distributes to be free of defects in materials and workmanship for the warranty period indicated from the date of installation for as long as the original retail purchaser owns the vehicle on which the part is installed and is non-transferable. This limited warranty applies to vehicles registered and normally operated in the United States.

 HTRP’s sole liability hereunder is limited to the purchase price of any product proven defective or, at the seller’s option, to the replacement of such product F.O.B. the seller’s warehouse.

IT IS UNDERSTOOD AND AGREED THAT SELLER’S LIABILITY AND PURCHASER’S SOLE REMEDY, WHETHER IN CONTRACT, UNDER ANY WARRANTY. IN TORT (INCLUDING NEGLIGENCE), IN STRICT LIABILITY OR OTHERWISE SHALL NOT EXCEED THE RETURN OF THE PURCHASE PRICE PAID BY PURCHASER, AND UNDER NO CIRCUMSTANCES SHALL SELLER BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, PROPERTY DAMAGE, DAMAGE TO OR LOSS OF EQUIPMENT, LOST PROFITS OR REVENUE, COST OF RENTING ANY REPLACEMENT OR ANY OTHER ADDITIONAL EXPENSES, EVEN IF SELLER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE PRICE STATED FOR THE EQUIPMENT IS A CONSIDERATION IN SO LIMITING SELLER’S LIABILITY AND PURCHASER’S REMEDY. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. The law of the State of Kansas shall apply to any resulting agreement with respect to a sale of the goods.

SELLER WILL NOT BE LIABLE FOR ANY DAMAGES, LOSSES OR EXPENSES AS A RESULT OF THE NEGLIGENCE OF THE PURCHASER OR ANY USER, WHETHER DEEMED ACTIVE OR PASSIVE AND WHETHER OR NOT ANY SUCH NEGLIGENCE IS THE SOLE CASE OF ANY SUCH DAMAGE, LOSS OR EXPENSE.

THIS WARRANTY IS IN LIEU OF AND EXCLUDES ALL OTHER WARRANTIES, EXPRESSED, IMPLIED, STATUTORY OR OTHERWISE CREATED UNDER APPLICABLE LAW, INCLUDING, BUT NOT LIMITED TO, THE WARRANTY OF MERCHANTABILITY AND THE WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. 

AS TO GOODS (OR COMPONENTS THEREOF) SOLD BY THE SELLER BUT MANUFACTURED BY OTHERS, THE BUYER SHALL

ACCEPT IN LIEU OF ANY LIABILITY, GUARANTEE, OR WARRANTY FROM THE COMPANY, THE BENEFITS OF ANY GUARANTEE
OR           
WARRANTY OBTAINED BY THE SELLER FROM THE MANUFACTURER THEREOF. THIS INFORMATION IS FURNISHED SOLELY TO NOTIFY THE BUYER THAT THEY MAY BE COVERED BY A WARRANTY FROM THE MANUFACTURER. THE SELLER IS NOT ADOPTING OR ASSUMING RESPONSIBILITY FOR THE MANUFACTURER’S WARRANTY, AND IS NOT MAKING ANY OTHER EXPRESSED OR IMPLIED WARRANTY INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE OR OF MERCHANTABILITY CONCERNING THESE GOODS.

WARRANTY OBTAINED BY THE SELLER FROM THE MANUFACTURER THEREOF. THIS INFORMATION IS FURNISHED SOLELY TO NOTIFY THE BUYER THAT THEY MAY BE COVERED BY A WARRANTY FROM THE MANUFACTURER. THE SELLER IS NOT ADOPTING OR ASSUMING RESPONSIBILITY FOR THE MANUFACTURER’S WARRANTY, AND IS NOT MAKING ANY OTHER EXPRESSED OR IMPLIED WARRANTY INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE OR OF MERCHANTABILITY CONCERNING THESE GOODS.

To make a claim, you must provide proof of purchase for all parts subject to a warranty claim. In the event that it is determined that the part must be replaced, the original part must be returned to HTRP to obtain the replacement part along with documentation showing that the warranty validation requirements have been fulfilled. HTRP must approve all returns and issue an RA number prior to the return. Any returns without an RA number will not be accepted. 

The following conditions will not be covered under warranty:

This warranty applies to defects in materials and workmanship; it does not apply to:

  • Normal worn parts.
  • Damage resulting from road hazards, gravel or debris.
  • Damage caused by excessive system pressures.
  • Damage caused by neglect, negligence, abuse, lack of maintenance, or use of corrosive cleaning materials. All vehicles/equipment must have a properly working engine overheat warning system as damage caused by overheating is considered driver negligence and will not be covered.
  • Corrosive damage caused by the effects of physical or chemical properties of water, steam, or other liquids or gases including the use of coolant or coolant mixtures other than that specified by the vehicle manufacturer.
  • External corrosion due to salt air corrosion in coastal areas.
  • Physical damage due to collisions, accidents, abnormal operation, abusive handling or shipping.
  • Stripped threads on any component of the radiator such as on engine oil cooler lines, transmission oil cooler lines, drain cocks or temperature sensor connections.
  • Improper storage prior to installation, improper installation, conditions that cause failure to the vehicles warning devices, or alteration or removal of the parts.
  • Electrolysis caused by excessive stray electrical current in the coolant system.
  • Exposed to salts, acids, bases or any potentially corrosive material.
  • Diagnostic, removal or re-installation labor charges.
  • Claims for loss of time, inconvenience, loss of use or other consequential damages.
  • Freight charges for either defective parts or new or repaired parts unless prior written approval is obtained from Seller.

RADIATOR VALIDATION REQUIREMENTS

To validate the Complete Radiator and Radiator Core warranties, the following measures must be undertaken. Failure to provide specific and documented proofs of original installation and subsequent replacement will void warranty coverage and the claim will be denied.

  1. Cooling system must be properly flushed and filled with new coolant mixture.
  2. Recommended coolant mixture should be a 50/50 mix of coolant and water or as recommended by vehicle manufacturer. It is highly recommended to use distilled water and it is mandatory for all aluminum cooling components.
  3. All external causes that can lead to electrolysis and/or corrosion must be verified and eliminated.
  4. Electrical, electronic, and/or mechanical devices, such as; thermostat, sensors, gauges, sending units, water pump and devices used to monitor and maintain optimal engine temperature, must be verified for proper operation.
  5. The installer must use recognized trade methods and procedures. HTRP shall not be liable for misrepresentation made by any third party regarding warranty application and/or coverage, nor does HTRP authorize any party to make any representation on behalf of HTRP. Only HTRP can authorize and approve warranty claims.

    ALL INCIDENTAL AND CONSEQUENTIAL DAMAGES ARE EXCLUDED FROM THIS WARRANTY TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW.
